Be careful how you use the word cheating. It carries significant implications. With that said, you have identified one of the reasons why poisoning food is challenging. Once people know that food is poisoned they can circumvent that delivery very easily.

I can say, with certainty, that the act of poisoning food IN GAME is a legitimate action. There are rules for it. You will not be punished for it. I say this as both a Marshal in CT and the head of National Customer Service.
